Terms of Service

These Terms of Service ("Terms") are an agreement between you and FlowSync Technologies ("FlowSync", "we", "us" or "our"). They cover your use of the FlowSync app and website (together, the "Service"). Please read them together with our Privacy Policy, which explains how we handle your information.

1Agreeing to these terms

By downloading, installing or using FlowSync, you agree to these Terms. If you don't agree, please don't use the Service.

You must be at least 13 years old, or the minimum age required in your country, to use FlowSync. If you use it on behalf of an organization, you confirm that you're allowed to accept these Terms for that organization, and "you" includes it.

2What FlowSync does

FlowSync is an app that uploads files from your device to your Google Drive and downloads files from your Google Drive to your device. To use it you need a Google Account, and your use of Google Drive remains subject to Google's own terms and policies.

FlowSync is an independent product. It isn't made, endorsed or supported by Google.

3Your account and your Google connection

You sign in to FlowSync with your Google Account and choose which permissions to grant. You're responsible for keeping your Google Account and your device secure, and for activity that happens through them.

You can disconnect FlowSync at any time from your Google Account settings. FlowSync depends on Google's services and APIs, which may change, limit or stop working for reasons outside our control. We aren't responsible for Google's services, storage limits or outages.

4Your files

Your files are yours. We don't claim any ownership of anything you upload or download with FlowSync.

To run the Service, you give us permission to access, copy, transmit and display your files only as needed to carry out the transfers you request and to show them to you in the app. This permission ends when you stop using FlowSync, except where the law requires us to keep information.

You're responsible for your files, and for having the rights you need to upload, download and store them.

5Acceptable use

Please don't use FlowSync to:

• break the law, or help anyone else break it;
• upload, store or share content that infringes anyone's rights, including copyright, or that is illegal, abusive or exploitative;
• spread malware or anything designed to harm devices, data or networks;
• overload or disrupt the Service or Google's systems, or try to gain unauthorized access to them or to anyone's account;
• get around usage limits, or use Google's APIs in ways that break Google's terms;
• copy, modify, reverse engineer or resell the Service, except where the law expressly allows it.

We may suspend your access if we reasonably believe you're breaking these rules, to protect other users, the Service or Google's systems.

6Plans and payments

FlowSync may offer both free features and optional premium subscriptions.

Some features may require a paid plan. Prices are shown before you buy, and taxes are included or added as stated at checkout. Paid plans renew automatically at the end of each billing period until you cancel. You can cancel at any time, and you'll keep access until the end of the period you've already paid for. Refund requests submitted within 14 days of purchase will be processed in accordance with applicable consumer laws. Payments are processed by our authorized third-party payment processor.

If we change our prices, we'll tell you in advance, and the new price will apply from your next billing period.

7Our intellectual property

The FlowSync software, name, logo and website belong to us or our licensors. We give you a personal, non-exclusive, non-transferable and revocable license to use the app for your own personal or internal business purposes, in line with these Terms.

Some parts of FlowSync may include open-source software, which is covered by its own license terms.

8Feedback

We love hearing ideas. If you send us feedback or suggestions, we may use them without any obligation to you.

9Changes to the Service

We're always improving FlowSync, so features may change, and some may be added or removed. If we make a change that significantly reduces what the Service does for you, we'll give you reasonable notice where we can. We may also pause the Service briefly for maintenance.

10Ending your use

You can stop using FlowSync at any time: uninstall the app and remove its access from your Google Account.

We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Service. Where reasonable, we'll tell you first. If we discontinue the Service entirely, we'll give you at least 30 days' notice. Either way, your files stay in your Google Drive and on your device.

Sections 4, 7 and 11 to 16 continue to apply after your use ends.

11Disclaimers

We work hard to make FlowSync reliable, but we provide the Service "as is" and "as available". To the extent the law allows, we make no promises or warranties of any kind, express or implied, including that the Service will be uninterrupted or error-free, that it will be fit for a particular purpose, or that every transfer will complete.

Please keep backups. Files can be lost or damaged in transit, by Google's services or on your device. FlowSync isn't a backup service, and you should keep copies of anything important.

12Limitation of liability

To the extent the law allows, FlowSync and its team won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising from or related to your use of the Service.

Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) $100 USD.

Some places don't allow these limits, so they may not apply to you. Nothing in these Terms limits liability that can't be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, and nothing affects your statutory rights as a consumer.

13Indemnity

To the extent the law allows, you agree to defend and indemnify FlowSync against claims, losses and costs (including reasonable legal fees) brought by third parties that arise from your files, your misuse of the Service or your breach of these Terms.

14Changes to these terms

We may update these Terms from time to time. We'll post the new version on this page and update the date at the top. If the changes are significant, we'll tell you in the app or by email at least 30 days before they take effect. If you keep using FlowSync after the changes take effect, you accept the new Terms. If you don't agree, please stop using the Service.

15Governing law and disputes

These Terms are governed by the laws of the applicable governing laws, without regard to conflict-of-law rules. Any dispute will be handled by the courts of competent jurisdiction, unless the law where you live gives you the right to bring a claim in your local courts.

If you're a consumer, you keep any protections the law of your home country gives you. Before starting a formal dispute, please contact us first. Most problems can be sorted out quickly.

16General

• Entire agreement: these Terms and our Privacy Policy are the whole agreement between you and us about the Service.
• Severability: if any part of these Terms can't be enforced, the rest still applies.
• No waiver: if we don't enforce a right straight away, we haven't given it up.
• Assignment: you can't transfer these Terms to anyone else without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
• Events outside our control: we aren't responsible for delays or failures caused by things we can't reasonably control, such as outages of Google's services or of your internet connection.
